Cyriel Ruers and Saskia Stolk represent an airline in its appeal to the Noord-Holland court against the decision of the Minister of Infrastructure and Water Management to limit the number of ground handling service providers at Schiphol Airport.
According to the minister, the intended infringement of the free market by capping the number of ground handling service providers to three is necessary to improve the ground handling situation at Schiphol, more specifically with regard to the workload for personnel, attention to quality and crowds on and around the platforms and in the baggage halls.
The airline disagrees with the minister because, among other things, it has not been substantiated that a reduction in the number of service providers will contribute to achieving the intended improvements, and the reduction is contrary to Directive 96/67/EC on access to the ground handling market at Community airports.
