Cyriel Ruers and Bas van Os wrote the article ‘Abuse of slots: enforcement on improper grounds?’ for Tijdschrift Vervoer & Recht (issue 2024/4).
A slot is the permission to use an airport's infrastructure at a certain time to land or take off. Airlines are bound by strict requirements for its use to ensure that scarce capacity at an airport is used efficiently. Slot abuse has been strictly enforced for several years. In 2022, the minister imposed over €1 million in fines. In 2024, the minister (through the Human Environment and Transport Inspectorate) continued the enforcement of slot abuse.
In the article, Cyriel and Bas elaborate on the questionable legal basis for slot enforcement (the Slot Regulation, Aviation Act and Slot Allocation Decree). Previously, Cyriel spoke at a meeting of the Dutch Transport Law Association on slot allocation, slot abuse and its enforcement by the Human Environmental and Transport Inspectorate.
