Martijn van de Hel recently assisted a company during an ACM investigation into consumer law compliance in the debt-collection industry. The ACM established the absence of any violation and therefore terminated its investigation.
The investigation is part of ACM’s long-running enforcement activities in the debt collection sector. Earlier this year, it already imposed fines on DeReisPlanner and Credit Invest for the collection of accounts for invalid agreements. ACM also regularly warns consumers not to pay bills to collection agencies that commit aggressive collection practices. For example, this week ACM issued a warning about Lootsma & Partners, Smits & Co and Inter Payment Service. To further support consumers, ACM developed a Toolkit collection for (debt) counsellors.
