Martijn van de Hel spoke about the “relaxation” of competition law and state aid during COVID-19 at an NGB webinar for the Professional Association for In-House Counsel on 23 April.
Using recent examples, Martijn illustrated the possibilities for competitors to join forces in these times of crisis. Martijn also summarised the Temporary Framework Regulations for State Aid during the current COVID-19 outbreak. Martijn furthermore addressed the “crisis cartel” phenomenon, which can be used to ensure that companies in ailing sectors are not forced off the market during the crisis, leaving behind an insufficient number of competitors. But there is a thin line between a lawful and an unlawful crisis cartel.
