Diederik Schrijvershof wrote a blog for M&A Community concerning the EUR 125 million fine which the European Commission imposed on Altice for controlling PT Portugal before clearance of this transaction (i.e. gun jumping). The Commission has been very active regarding gun jumping. The Commission has started an investigation regarding gun jumping by Canon. At the same time the Commission is investigating the reported providing of incorrect information during the assessment of a merger. The Commission imposed a high fine on Facebook in 2017. The focus on gun jumping and other administrative rules concerning the merger notification process will continue both inside and outside the Netherlands. In 2017 The Netherlands Healthcare Authority (NZa) imposed a fine on a healthcare provider for implementing a merger before obtaining clearance of the NZa.
