Martijn van de Hel has been interviewed by NRC Handelsblad as to whether the Netherlands Authority for Consumers & Markets (“ACM”) loses too often in cartel proceedings. NRC writes:
“ACM loses remarkably often in court”, says Martijn van de Hel of Maverick Advocaten, articulating the sentiment among many competition lawyers. In recent years, among other things, he has successfully contested administrative cartel charges against house brokers and battery suppliers.
Martijn van de Hel, who has represented the house brokers, believes that ACM is too easily inclined to bring charges. “The law was changed in 2016, allowing ACM to impose higher fines. If ACM continues to lose since then, it has defeated its purpose.”
