Maverick Advocaten has successfully defended T-Mobile against a claim of more than €16 million filed by UPC. UPC had taken the position before the Court of Appeal of The Hague that T-Mobile had abused its (alleged) dominant position on the call termination market by charging rates that exceeded rates based on a specific cost allocation system. In its judgment of 11 March 2015 the Court of Appeal rejected all of UPC’s claims. The Court of Appeal found in that regard, among other things, that UPC had insufficiently substantiated its claims. It thereby upheld an earlier judgment passed by the Rotterdam Court.
