Judith Jansen and Cyriel Ruers are litigating on behalf of several food companies against turnover fines that the Netherlands Food and Consumer Product Safety Authority (NVWA) has imposed on these companies.
In recent years, the NVWA has imposed sales fines on several food companies. The NVWA imposed the fines because the companies in question allegedly did not cooperate sufficiently in the context of recall obligations imposed by the NVWA.
The food companies do not agree with the fines, as there was no food safety risk and therefore no recall obligation. The companies also state that they each cooperated fully with the NVWA. Maverick Advocaten is litigating against the sales fines in both the Rotterdam court and the Trade and Industry Appeals Tribunal (CBb).
