Diederik Schrijvershof and Annabel Kingma have successfully represented real estate platform Funda in an investigation by ACM into allegedly unreasonable conditions set by Funda for access to Funda. Housing brokerage site Gmak had requested ACM to take enforcement action. According to Gmak, Funda imposed excessive conditions regarding the working method and content of the services of estate agents and housing brokers that are not members of the NVM, VBO or VastgoedPro real estate associations. They were allegedly excluded from Funda if they did not meet those conditions. A preliminary investigation by ACM did not produce any convincing evidence that the conditions set by Funda disadvantage brokers and homeowners.
