Martijn van de Hel has successfully represented EBS in its defence against Connexxion’s request for preliminary relief against the awarding of the concession for district bus transport in the Haaglanden region.
The concession relates to the district bus transport in the Haagland region in the 2019-2030 period. The Metropoolregio Rotterdam Den Haag (MRDH) awarded the concession to EBS. EBS’s tender received the highest number of points in the tendering procedure. Connexxion disagreed with that outcome and filed an objection. At the same time it requested the Trade and Industry Appeals Tribunal (CBb) to suspend the award by way of preliminary relief
The preliminary relief judge of the CBb rejected Connexxion’s request to grant preliminary relief. The CBb preliminary relief judge saw no reason to assume that EBS’s tender did not meet the tender requirements. The awarding of points to the tenders did not give rise to such questions as were grounds for the judge to take action.
