Martijn van de Hel and Saskia Stolk have successfully assisted a web store for consumer electronics in a sanction procedure of the Authority for Consumers and Markets (“ACM”).
The ACM conducted a large-scale investigation into fake discounts in the following three sectors: clothing, consumer electronics and beds. As a result of this investigation, the ACM planned to impose a fine on a consumer electronics web store. According to the ACM, the web store had used fake discounts. This violates the Prices Act and the Decree on Product Pricing. After a hearing took place, the ACM decided not to impose a fine after all. The ACM corrected the conclusions from its own investigation report by finding that one of the presumably erroneous announcements of a price reduction was not a fake discount. In addition, another presumably erroneous announcement was a comparison to a recommended retail price. Comparisons to a recommended retail price were not within the scope of this investigation by the ACM.
