Maverick Advocaten is assisting T-Mobile Netherlands B.V. (T-Mobile) with its appeal to the Trade and Industry Appeals Tribunal against the regulation of MTA rates – the network access rates charged by mobile telephony providers. In its decision of 5 August 2013 the Authority for Consumers and Markets fixed these rates for 2013-2016, with no compensation for common costs. T-Mobile is contesting this decision and has submitted an appeal to the tribunal. Pending the outcome of the appeal, the provisional relief judge has suspended the implementation of the new rates and decided that mobile telephony providers may charge rates that include an allowance for mutual costs.
Maverick Advocaten also assisted T-Mobile in its successful petition to suspend the decision, and is now representing it in the appeal procedure.
