Diederik Schrijvershof filed an enforcement request with the Netherlands Healthcare Authority (“NZa”) on behalf of GGZ Nederland. The enforcement request relates to breach of the Transparency in Healthcare Procurement Regulations under the Healthcare Insurance Act (“Healthcare Procurement Regulations”) by several healthcare insurers. The 2020 mental healthcare procurement (acute and non-acute mental healthcare) was consequently delayed. More information on the background of the enforcement request can be found here.
In 2019 already the NZa issued five formal warnings for breaches of the Healthcare Procurement Regulations. The NZa warned healthcare insurers Zorg en Zekerheid, CZ, VGZ (twice) and DSW in 2019 on the grounds of breaches of the Healthcare Procurement Regulations. The NZa previously imposed a penalty on DFZ (a division of Zilveren Kruis) for breach of the Healthcare Procurement Regulations. More information can be found here, here and here. The NZa has now again announced its intention to more strictly enforce the Healthcare Procurement Regulations.
Maverick Advocaten has long advocated adequate mandatory rules (and the enforcement of those rules) for healthcare insurers in healthcare procurement and the fighting of excessive procurement power of healthcare insurers.
