A team of Maverick Advocaten assisted Multi Tank Card, provider of mobility cards MTc and MoveMove, in presenting its opinion on the draft Advice regulation of payment services in public transport of the Dutch Authority for Consumers and Markets (ACM). In its final advice, the ACM recommends the Ministry of Infrastructure and Water Management to impose on Trans Link Systems, the organization behind the Dutch ‘OV-chipkaart’, the obligation to grant providers of mobility services access to payment services in public transport.
The advice of the ACM fits within the recent trend of applying ex-ante regulation to new sectors in order to enhance competition. Similar to the recently revised Payment Services Directive (read this blog for more information about PSD2), this advice aims to create a level playing field between established market players and innovative entrants on the market.
