Cyriel Ruers and Bas van Os assist an importer of lysine during an anti-dumping investigation by the European Commission. This investigation was initiated by the Commission on the 23st of May 2024.
The investigation concerns alleged dumping of lysine originating in China. The anti-dumping proceedings were initiated following a complaint by METEX, the sole producer of lysine in the European Union. METEX claims that imports of lysine are being dumped on the EU market and cause injury to the Union industry. As part of this investigation, various stakeholders such as intermediaries, exporters and importers are participating in the investigation.
A non-EU company is considered dumping a product, if a product is exported to the EU at a price lower than the normal value of the product. This normale value is based on the prices on the cost of production, or the prices on the home market of the exporter. The Commission may, if it finds dumping that causes injury to the Union industry, impose (provisional) anti-dumping measures, which consist of import duties.
