Martijn van Hel and Silvia Vinken (Banning N.V.) are assisting around 50 auction traders with a claim for damages against the Netherlands Authority for Consumers and Markets (ACM). The ACM fined the traders for alleged collusion in foreclosure auctions. The CBb has annulled these fines in their entirety. According to the CBb, ACM has not provided sufficient proof of the alleged restriction of competition by the traders. The traders have suffered damages as a result of these unlawful decisions.
