Martijn van de Hel is door Global Competition Review (“GCR”) geïnterviewd over het onderzoek van de ACM naar de toegang van betaalapps tot NFC communicatie in smartphones.
NFC communicatie is de communicatiemethode die het mogelijk maakt om contactloos te betalen met een smartphone. Doordat de software van sommige smartphones enkel de softwareontwikkelaar toegang biedt aan NFC communicatie, vreest de ACM dat de innovatie op het gebied van betaalapps wordt belemmerd. Daarnaast onderzoekt de ACM of door de beperking van de toegang voor betaalapps de keuzevrijheid van smartphonegebruikers wordt beperkt.
GCR heeft Martijn gevraagd op dit onderzoek van de ACM te reageren. GCR schrijft:
“Maverick Advocaten partner Martijn van de Hel in Amsterdam said the Dutch authority’s investigation is surprising, as its market study found that payment apps do not yet play an important role in the Netherlands and big tech companies “are far from dominant” in the country’s payment sector.
The “key question” will be whether there is a real competition law issue or if the agency has been “too eager” in choosing to begin its probe “too soon”, van de Hel said. He predicted that the authority is unlikely to “be able to establish a violation of the competition rules”.”
