Cyriel Ruers successfully assisted a Dutch dropshipping company in an investigation by the Authority Consumer and Market (“ACM”) into alleged non-compliance with online sales rules. This e-commerce company operates a successful Dutch webshop, based on a dropship model. Following a large number of consumer complaints about the handling of orders, including non-delivery or delayed delivery, and media coverage of this site, the ACM launched an investigation. Maverick Advocaten assisted the company in question during the investigation, after which the ACM ended its investigation without imposing a penalty.
Maverick Advocaten regularly assists companies in investigations by the ACM into alleged violations of consumer rules (misleading trade practices) and competition law. For example, Maverick Advocaten previously assisted another dropshipper in a similar investigation and a sports store chain in an ACM investigation into greenwashing (see here).
